These terms apply to every order for the VHF Watch Recorder placed on this website. They are written for consumers. If you buy as a business, write to us first: these terms then apply with the changes noted in section 15.

In these terms "we" and "us" means PRAGRE OG, and "you" means the person placing the order.

2. What we sell, and what is free

We sell one product: the VHF Watch Recorder, a device that connects to a marine VHF radio and records the transmissions it receives to a memory card. What is in the box and the technical data are shown on the product page at the time you order.

The VHF Watch app (for iPhone, Android, macOS and Windows) is free and is not part of this contract of sale. It is licensed separately under our terms of use. The recorder needs the app to show, transcribe and sort recordings. Until the app is available in the relevant app store, we will not ship a recorder without telling you how to install it.

The recorder is a listening aid, not certified safety or radio equipment. It does not replace a listening watch or any duty you have under the COLREGs, the SOLAS/GMDSS rules or the law of your flag or the waters you sail in. Transcriptions and classifications can be wrong, and calls can be missed.

3. Pre-orders

While the product page says Pre-order, the recorder is not yet in stock. The page states when we expect to ship the batch you are ordering from. This is an estimate, not a fixed delivery date.

  • We charge the full price when you order.
  • You can cancel a pre-order at any time before we ship it, without giving a reason, by email to office@pragre.com. We refund the full amount, including shipping, within 14 days, to the payment method you used.
  • If the expected date moves, we tell you by email, with the reason and the new estimate.
  • If we cannot deliver within 6 months of the originally stated date, either of us may cancel the contract and you receive a full refund. Your statutory rights in case of late delivery are unaffected.
  • Your 14-day right of withdrawal (section 9) starts only when you receive the recorder, and is in addition to the right to cancel before shipping.

4. Prices

All prices are in euros and include VAT at the rate applicable to your order. Shipping costs are shown separately before you pay and depend on the shipping region you choose. The price shown at the time of your order applies.

Pre-order list discount. Whoever confirmed their email address on our pre-order list receives a discount code when the recorder goes on sale. The code gives 50% off the price of one recorder (not shipping), can be used once per email address, and is valid for 30 days after the email that sends it. It cannot be exchanged for cash or combined with other codes. Joining the list is free and is not an order or a reservation.

For deliveries outside the European Union, import VAT, customs duties and carrier handling fees may be charged by the authorities or the carrier of the destination country on delivery. These are not part of our price; see shipping.

5. How the contract is made

1. On the product page you choose the quantity and your shipping region and click the order button. 2. You are taken to the payment page of our payment provider, Stripe. There you enter your email, delivery address and payment details, and see the product, quantity, total price including VAT and shipping costs. 3. By clicking the payment button on that page you place a binding order. Until then you can correct your entries or cancel the process by closing the page or returning to our site. 4. The contract is made when the payment is authorised and we confirm your order by email. The confirmation contains the main contract terms. These terms of sale remain available on this page.

The contract language is English. We do not keep a separate copy of your contract for you to access later, so please keep the confirmation email.

6. Payment

Payment is processed by Stripe Payments Europe, Ltd. (Dublin, Ireland). The payment methods offered are those shown on the Stripe payment page. Your card or payment details go to Stripe and are not seen or stored by us. Payment is due when you order, also for pre-orders.

7. Delivery

We deliver to the countries listed on the shipping page, to the address you entered. Delivery times are stated there. Risk passes to you when the recorder is delivered to you or to a person you name.

If a parcel arrives visibly damaged, please note it with the carrier if you can and tell us. This helps us claim from the carrier; it does not affect your rights.

8. Retention of title

The recorder remains our property until it is paid for in full.

9. Right of withdrawal

As a consumer you can withdraw from the contract within 14 days of receiving the recorder, without giving a reason. How this works, who pays for the return and a model withdrawal form are on the right of withdrawal page.

10. Warranty

You have the statutory warranty rights (Gewährleistung) under Austrian law, in particular the Consumer Warranty Act (VGG). The warranty period is two years from delivery. If a defect shows within the first year, it is presumed to have existed at delivery.

If the recorder is defective, write to office@pragre.com with your order number and a short description. We will first repair or replace it, at our cost. If that is impossible, too costly or fails, you can ask for a price reduction or, for a defect that is not minor, end the contract.

We do not give any additional commercial guarantee beyond the statutory warranty.

Not a defect: damage from wrong wiring (for example connecting to a bridged speaker output against the wiring guide, wrong polarity, or no fuse), water ingress beyond what the product page states, or the normal limits of transcription described on the product page.

11. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury. For damage to property caused by slight negligence, our liability is excluded, except where the law does not allow this. Claims under the Austrian Product Liability Act (PHG) are not affected.

The recorder and the app are an aid. They are not designed or certified to ensure the safety of a vessel or of people. We are not liable for the consequences of relying on them instead of keeping a proper listening watch, to the extent the law allows this.

12. Recording radio traffic

Listening to marine VHF is permitted everywhere. Recording it, keeping recordings and passing on their content are restricted in some countries and waters. You are responsible for using the recorder in line with the rules that apply where you sail. The app gives you controls for how long recordings are kept and to delete them.

13. Your data

We process the data needed for your order as described in our privacy policy.

14. Disputes

If something goes wrong, please write to us first at office@pragre.com. We are not obliged to take part in proceedings before a consumer arbitration body.

15. Business customers

If you buy as a business, the statutory warranty is replaced by our obligation to repair or replace a defective recorder within 12 months of delivery, the duty to inspect and notify defects under § 377 of the Austrian Commercial Code (UGB) applies, and the right of withdrawal does not apply.

16. Governing law and venue

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not take away the protection of the mandatory consumer law of the country where you habitually live.

For consumers, the courts of the place where you live, or another court competent by law, have jurisdiction. For businesses, the competent court in Linz, Austria.

17. Final provisions

If a provision of these terms is invalid, the rest remain valid. We may change these terms for future orders; the version in force when you ordered applies to your order.
