Scope
These terms apply to the use of this website and of the VHF Watch app for iPhone, Android, macOS and Windows, both provided by PRAGRE OG, Dornlandweg 11, 4040 Linz, Austria. Buying the VHF Watch Recorder is covered separately by our terms of sale. Where you download the app from an app store, that store's terms also apply.
The app is free
The app costs nothing, has no subscription, no in-app purchases and no advertising, and needs no account.
Licence to use the app
We give you a free, non-exclusive, non-transferable right to install and use the app on devices you own or control, for your own use with a VHF Watch Recorder, including on a vessel you skipper for others. You may not sell or rent the app, remove notices of rights, or use it to break the law.
The app contains open-source components, which are licensed under their own terms. Those terms take precedence for those components.
What the app does, and what you should know
The app collects recordings from your VHF Watch Recorder over your local network, turns the speech into text on your device and sorts each call: possible distress (Mayday), possible urgency (Pan-pan), safety (Sécurité), a call for your boat, all ships, or traffic between other vessels. It raises alerts for some of these.
- It is an aid, not a listening watch. It does not replace a proper listening watch or any duty you have under the COLREGs, the SOLAS/GMDSS rules or the law of your flag state or the waters you sail in.
- It is not certified safety or radio equipment, and it does not decode DSC.
- Transcripts and labels can be wrong, in both directions. On Mayday, Pan-pan and your boat's name the app is designed to raise a false alarm rather than stay silent; it can still miss a call. Every call keeps its audio so you can listen yourself.
- Alerts can be delayed or not shown: for example if the app is force-closed on iPhone, if your device silences notifications, or if the recorder or the network is not working.
- Recording radio traffic is restricted in some places. Listening to VHF is allowed everywhere; recording it, keeping it and passing it on are not, in some countries and waters. You are responsible for using the app and the recorder in line with the rules where you sail.
No warranty for the free app
The app is provided free of charge, as it is. We do not promise that it is free of errors, that it will run without interruption or on every device, or that it will hear, transcribe or classify every call correctly. Your statutory rights for the recorder you bought are set out in the terms of sale and are not affected.
Liability
We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury. For other damage caused by slight negligence in connection with the free app or this website, our liability is excluded, to the extent the law allows. Mandatory consumer protection and product liability law are not affected.
Availability of the website
We try to keep this website available but cannot guarantee it. We may change or take down content at any time.
Changes to these terms
We may change these terms when the app or website changes. The version shown here applies from its date. Continuing to use the app after a change means you accept the new version; if you do not, stop using the app.
Governing law and venue
Austrian law applies, excluding its conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory law of the country where you habitually live, and you can sue and be sued in the courts there.
Severability
If a provision of these terms is invalid, the rest remain valid.
